Compliance Advisory That Reflects
How Thai Regulators Actually Work

The difference between adequate compliance advice and useful compliance advice in Thailand lies in whether the adviser understands the supervisory context — not just the statute.

§ 1 — Overview

What Clients Gain From Working With Us

Six qualities that distinguish our approach from general advisory services in the compliance space.

Thai Supervisory Knowledge

Our advisers have worked directly within the Thai regulatory system — with the SEC, BOT, and AMLO — not through secondary study of their frameworks.

Fixed Fees, Defined Scope

Every engagement is costed and scoped before work begins. Clients know precisely what they are paying for and when deliverables will arrive.

Senior Adviser Delivery

Work is handled by the adviser you engage with — not routed to junior staff. This applies to every engagement type, including the longer programme.

Bilingual Documentation

Policy documents and regulatory correspondence can be produced in Thai and English within the same engagement, without subcontracting the translation.

Operationally Realistic Advice

Recommendations are calibrated to how your company actually functions — its staff, systems, and budget — not to an ideal compliance posture that cannot be maintained.

Regulatory Change Coverage

Programme clients receive structured quarterly briefings on BOT, SEC, AMLO, and PDPA developments — synthesised into clear, sector-relevant summaries.

§ 2 — In Detail

Each Benefit, Explained

Professional Expertise

Advisers Who Have Sat on the Other Side of the Table

Understanding how a supervisory body conducts its reviews — what examiners look for, which documentation patterns prompt follow-up questions, and what constitutes a satisfactory response to an information request — is knowledge that comes from experience, not from reading the published guidance.

Our advisers' backgrounds in Thai regulatory environments mean that the advice you receive reflects that operational understanding, not just a technically correct reading of the rules.

What This Means in Practice

  • Health Check findings reflect actual BOT/SEC examination priorities, not generic compliance categories
  • Policy documents are drafted in a style and structure that Thai regulators recognise
  • Responses to regulator information requests are pitched at the right level of detail
  • Programme clients receive advance notice of regulatory developments, not post-hoc summaries

Fee Structure at a Glance

Compliance Health Check ฿4,800
Policy & Procedure Drafting ฿18,800
Year-Long Counsel Programme ฿38,800 / year

All fees are fixed at engagement commencement. Out-of-pocket costs discussed in advance only.

Value & Pricing

Proportionate Fees for Defined Engagements

The three engagements are structured to address the most common compliance needs of small and mid-sized Thai companies at a cost that is proportionate to their size. There are no open-ended retainers for the first two engagements, and the year-long programme is costed as an annual flat fee.

This structure avoids the uncertainty of hourly billing and allows companies to plan their compliance expenditure as a known budget item rather than an open-ended professional services cost.

Client Service

A Direct Line to the Adviser Handling Your Work

Programme clients have a named adviser as their primary contact throughout the engagement year. For the Health Check and Policy Drafting engagements, the same adviser who leads the work is also the person you contact with questions during the engagement.

We respond to client enquiries within one business day. For matters that arise under the Year-Long Counsel Programme with greater urgency, same-day telephone responses are the norm rather than the exception.

Service Standards

  • Named adviser contact for every engagement
  • One business day response to all written enquiries
  • Telephone access during Bangkok office hours
  • Engagement letter confirms all commitments in writing

§ 3 — Comparison

How We Differ From General Advisory Providers

A factual comparison of what structured compliance advisory offers relative to broader professional services arrangements.

Feature Typical General Adviser Mongkut Advisory
Thai regulatory body knowledge (SEC, BOT, AMLO) Variable Direct experience
Fixed-fee engagement structure Hourly billing Fixed fee, defined scope
Bilingual policy drafting (EN/TH) Subcontracted In-house capability
Senior adviser carries engagement end-to-end Often delegated Named adviser throughout
Quarterly regulatory update briefings Ad hoc or absent Included in programme
Engagement letter with confirmed scope before work begins Not always standard Mandatory for all work

§ 4 — Distinctions

Features Not Commonly Found Elsewhere

Regulator Meeting Attendance

Under the Year-Long Counsel Programme, attendance at BOT, SEC, or AMLO meetings is included where the body's procedure permits adviser participation. This is rarely offered as a standard feature of advisory engagements.

NDA Available Pre-Discussion

For companies with sensitive matters, a non-disclosure agreement can be put in place before any substantive initial conversation — not as an afterthought following engagement.

Report Written for Regulatory Use

The Health Check report is structured and worded to be directly usable in conversations with supervisory bodies — not written primarily as internal management commentary.

Three-Tier Engagement Design

The three engagements are designed to fit sequentially if needed: a Health Check can inform a subsequent Policy Drafting engagement, which in turn provides the foundation for the ongoing programme.
