The workshop was well-structured and the final documents were written in a way that clearly referenced Thai regulatory language rather than a generic international template. The bilingual versions were also useful for our Thai-speaking board members. The engagement ran to about five weeks, which matched what was agreed at the outset.

The quarterly regulatory briefings are the most useful part — they summarise relevant SEC and BOT developments in about three pages, which is far more useful than trying to monitor the original circulars ourselves. The Data Protection Policy is proportionate to our size — it is not a 40-page document that nobody will read, but it covers the substantive requirements in a way that would stand up to scrutiny. Case Study 1 — Health Check + Policy Drafting
Mid-sized fintech preparing for BOT examination
The Challenge
A payment service provider operating under a BOT e-money licence received notice of an upcoming examination. Their internal AML documentation had not been updated since their original licence application three years prior, and their KYC procedures had evolved informally without being recorded in policy form.
The Work
Mongkut began with a Health Check focused on AML and governance documentation. The findings report identified four areas requiring attention before the examination. A subsequent Policy Drafting engagement produced an updated AML manual, a revised KYC procedure document, and a delegation of authority matrix — all in Thai and English.
The Outcome
The BOT examination concluded without a formal notice of deficiency. The examiner's feedback noted that the AML documentation was well-organised. Total engagement time across both engagements was approximately eight weeks. Total fee: ฿23,600.

Case Study 2 — Year-Long Counsel Programme
Licensed asset manager navigating ongoing SEC obligations
The Challenge
A boutique asset manager with SEC fund manager licence held had a compliance officer who was also responsible for risk and operations. The volume of SEC guidance notes and the time required to respond to ad hoc information requests was exceeding what that person could manage alongside other responsibilities.
The Work
The Year-Long Counsel Programme was established with Mongkut as the named adviser for SEC-related compliance questions. During the year, the adviser handled responses to two formal information requests from the SEC, attended one SEC supervisory interview, and produced four quarterly briefings summarising developments relevant to fund managers.
The Outcome
Both information request responses were acknowledged without follow-up from the SEC. The compliance officer reported that the quarterly briefings reduced the time she spent monitoring regulatory output by an estimated 60%. The programme was renewed for a second year.

Case Study 3 — Health Check
Regional company establishing Thai subsidiary under AMLO reporting
The Challenge
A Singapore-headquartered company establishing a Thai subsidiary in the real estate advisory sector needed to understand which Thai regulatory obligations would apply from the point of incorporation — particularly under AMLO, which had recently extended its scope to real estate intermediaries.
The Work
The Health Check was scoped specifically around AMLO applicability, corporate governance requirements for the Thai entity, and PDPA obligations given the company would hold client data. The engagement was completed in two and a half weeks, with the findings report structured to support the parent company's internal legal team in understanding the Thai position.
The Outcome
The subsidiary was incorporated with a clear compliance framework in place. The parent company's legal team used the findings report to brief their regional compliance committee. The Thai entity subsequently engaged Mongkut for the Policy Drafting engagement to formalise their AML and PDPA documentation before commencing client-facing activity.
